Access to Information (PAIA) Compliance

Access to information has a shadowy past in South Africa. Luckily, thanks to the Constitution, this secrecy is behind us. The Constitution grants us the right to access any information held by another person, and that is required for the exercise or protection of any rights, and to provide for matters connected therewith.

To achieve this transparency, we have the Promotion of Access to Information Act, or PAIA. PAIA allows for anyone to submit a request for information, held by certain bodies, to be made available. These bodies include all businesses, from natural persons and sole proprietors, to private companies and listed multinationals. 

Private bodies were however previously exempt from PAIA compliance, but this has all changed with the deadline for PAIA compliance now set on 31 December 2021. It’s then very likely that PAIA compliance will apply to you, and your company must take action before the 31 December 2021 deadline.
